Terms of Service

1. Acceptance of Terms

By accessing or using the MiFurBaby platform ("Service"), operated by Canery LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MiFurBaby is a marketplace platform that connects pet owners with independent pet sitters. We provide the technology to facilitate these connections but do not employ pet sitters, nor do we directly provide pet care services. Pet sitters are independent contractors who set their own prices, schedules, and service terms.

3. Eligibility

You must be at least 18 years old to create an account and use MiFurBaby. By registering, you represent that you are of legal age and have the capacity to enter into a binding agreement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Update your information to keep it accurate and current
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party

5. Pet Sitter Terms

Pet sitters using MiFurBaby agree that:

• They are independent contractors, not employees of MiFurBaby or Canery LLC
• They are solely responsible for the quality and safety of their pet care services
• They will comply with all applicable local, state, and federal laws
• They will maintain any required licenses, permits, or insurance for their services
• They will accurately represent their experience, qualifications, and services

6. Pet Owner Terms

Pet owners using MiFurBaby agree that:

• They are responsible for providing accurate information about their pets, including health conditions, behavioral issues, and special needs
• They will ensure their pets are up to date on vaccinations as required by their jurisdiction
• They are responsible for vetting and selecting their pet sitters
• MiFurBaby is not liable for any injury, loss, or damage related to pet care services

7. Payments & Fees

MiFurBaby facilitates payments between pet owners and pet sitters. Platform fees vary by subscription tier and are disclosed to sitters during onboarding. Pet owners pay no booking fees. Payment processing is handled by third-party providers (Stripe), and their terms of service also apply. Pet sitters may also accept direct payments through Venmo, Cash App, or cash as configured in their profiles.

8. Subscriptions

Pet sitters may subscribe to paid plans for enhanced features and reduced platform fees. Subscriptions auto-renew unless cancelled before the end of the billing period. Refunds are handled in accordance with applicable law and our refund policy. You may cancel your subscription at any time through the app settings.

9. User Content

You retain ownership of content you submit (photos, reviews, profile information). By posting content on MiFurBaby, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Service. You agree not to post content that is illegal, defamatory, harassing, or infringes on the rights of others.

10. Prohibited Conduct

You may not:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Post false or misleading information
• Harass, abuse, or harm other users
• Attempt to circumvent platform fees or payment systems
• Scrape, data mine, or use automated systems to access the Service
• Interfere with the security or integrity of the Service

11. Limitation of Liability

MiFurBaby and Canery LLC are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to injury to persons or pets, property damage, or loss of income. The Service is provided "as is" without warranties of any kind. We do not guarantee the quality, safety, or legality of services provided by pet sitters.

12. Background Checks

MiFurBaby offers optional background checks for pet sitters through third-party providers. Background checks are not a guarantee of safety. Pet owners should exercise their own judgment when selecting a sitter, regardless of background check status.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through your account settings.

14. Dispute Resolution

Any disputes between pet owners and pet sitters should be resolved directly between the parties. MiFurBaby may assist in mediation but is not obligated to do so. Any disputes with MiFurBaby or Canery LLC shall be resolved through binding arbitration in the state of South Carolina, in accordance with applicable arbitration rules.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
